Danville home health care avoided paying more than $100,000 for overtime hours to employees

Danville, Virginia – According to a federal investigation, a Danville home health care business avoided paying over $100,000 for overtime hours to more than 50 employees.
The outcome of the investigation into Angel Wings Home Health Inc. was released by the US Department of Labor on Monday.
According to the Department of Labor, 53 personal care aides and licensed nursing assistants worked overtime hours and were not paid $99,427 for the additional time worked.
Additionally, the investigation discovered that the employer violated the FLSA’s overtime and recordkeeping rules by failing to pay personal care aides and nursing assistants time and a half when they worked more than 40 hours in a workweek, as required by the FLSA.
That money has now been recovered by the Department of Labor for those employees.
Between Danville and South Boston, the company provides personal and respite care, feeding/meal preparation, household duties, laundry, errands, and companionship services.
According to the Department of Labor, Angel Wings also failed to keep correct records of total weekly hours worked, as required by federal law.
“Overtime and other wage violations are all too common among home healthcare workers. Employers’ failure to abide by the law and pay wages fairly harms these essential workers who serve their communities by providing critical care services during a national health care crisis. We will hold employers accountable when they fail to uphold their legal obligations,” said Wage and Hour Division District Director Roberto Melendez in a news release about the investigation.
